If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Once Upon provides an AI-powered storytelling and content generation platform that allows users to create, customize, and share personalized stories and creative content. Features may include but are not limited to character creation, story generation, image generation, and content sharing.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

To access certain features, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials confidential
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts at our discretion, including for violations of these Terms.

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, or offensive
• Create or distribute content that infringes on any intellectual property rights
• Generate content involving the sexual exploitation of minors
• Impersonate any person or entity or misrepresent your affiliation
• Attempt to reverse-engineer, decompile, or extract the underlying models or systems
• Use automated means to scrape, crawl, or index the Service
• Circumvent any rate limits, access controls, or usage restrictions
• Use the Service in any way that could damage, disable, or impair the platform

Your Content

You retain ownership of content you provide as input to the Service (“User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display it solely for the purpose of providing the Service to you.

Generated Content

Content generated by the Service using your inputs (“Generated Content”) is provided to you for your personal or commercial use, subject to these Terms. We do not claim ownership over Generated Content, but we make no representations regarding its originality, copyright status, or freedom from third-party claims.

You are solely responsible for ensuring that your use of Generated Content complies with applicable laws and does not infringe third-party rights.

Our Intellectual Property

The Service, including its design, software, models, and branding, is owned by Compose LLC and protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works from our proprietary materials.

Certain features of the Service may require a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your selected plan
• Provide valid payment information and keep it current
• Authorize us to charge your payment method on a recurring basis

Subscriptions auto-renew unless cancelled before the renewal date. All fees are non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to change pricing with reasonable notice.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

The Service may integrate with or rely on third-party services (e.g., AI model providers, payment processors, cloud infrastructure). We are not responsible for the availability, accuracy, or practices of any third-party service. Your use of third-party services is subject to their respective terms and privacy policies.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS.

We do not warrant that Generated Content will be accurate, appropriate, or free from errors. AI-generated content may be unexpected or unsuitable for your intended use, and you use it at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPOSE LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Compose LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

You waive any right to participate in class action lawsuits or class-wide arbitration related to the Service.

We may update these Terms from time to time. When we do, we will revise the Effective Date at the top of this page. If changes are material, we will provide notice via email or within the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
